CANADA

REGULATIONS

Off-Road Compression-Ignition Engine Emission Regulations (Canadian Environmental
Protection Act, 1999): SOR/2011-261 amends the regulations to reduce emissions from off-road
diesel engines by imposing stricter emissions standards. These amendments will align Canadian
emission standards with those introduced by the U.S. Environmental Protection Agency in 2004.

ALBERTA

REGULATIONS

Dangerous Goods Transportation and Handling Regulation (Dangerous Goods Transportation
and Handling Act): Alta. Reg. 211/2011 amends the regulation to repeal sections 4 and 5. CSA
Standards B620 and B621 are no longer cited in the regulation.

Pipeline Regulation (Pipeline Act): Alta. Reg. 228/2011 adds the definition of "flowing water" to
section 1(1) and replaces section 35 regarding contingency plans for liquid test media.

BRITISH COLUMBIA

REGULATIONS

Consultation and Notification Regulation (Oil and Gas Activities Act) B.C. Reg. 199/2011
amends the regulation to repeal Part 4 (Service). That information is now included in a separate
Service Regulation.

Occupational Health and Safety Regulation (Workers' Compensation Act): B.C. Reg. 188/2011
is now in force. Part 9 has been amended to clarify that atmospheric testing must be done by a
qualified person. In addition to many other amendments, several sections across the have been
updated to reflect the most recent legislation and standards. Part 5 (Chemical Agents and
Biological Agents), removed the requirement of prior approval for certain work related to
extended work periods. Part 14 (Cranes and Hoists) removed the requirement of prior approval
for certain work relating to chimney hoists. Part 19 ( Electrical Safety) removed the requirement
of prior approval for certain work relating to high voltage. Part 21(Blasting Operations)
removed the requirement of prior approval for certain work relating to mobile drill rigs.

MANITOBA

REGULATIONS

Biodiesel Mandate for Diesel Fuel Regulation (Biofuels Act): Man. Reg. 194/2011 amends the
reporting period for biodiesel fuel suppliers and outlines requirements for reports submitted for
the interim period.

Drilling Regulation, 1992 (Mines and Minerals Act): Man. Reg. 204/2011 amends section 5.1
regarding the application for a borehole licence.

Joint Environmental Assessment Regulation (Environment Act): Man. Reg. 207/2011 repeals
subclause 2(d)(ii).

NEWFOUNDLAND AND LABRADOR

REGULATIONS

Food Premises (Food and Drug Act): N.L.R. 7/12 replaces the definition of "mobile preparation
premises" in section 2 and adds subsections 6(3) and (4).

Workplace Health, Safety and Compensation Regulations (Workplace Health, Safety and
Compensation Act) N.L.R. 109/11 repeals and replaces Section 28.1 (Deferred payment
arrangement).

NOVA SCOTIA

ACTS

Motor Carrier Act: S.N.S. 2011, c. 8 amends the Act to update references to the correct
departments and ministries.

ONTARIO

ACTS

Planning Act: S.O. 2011, c. 6, Sch. 2 is now fully in force. In addition to other amendments,
subsection 35.1 (By-laws to give effect to second unit policies) has been added to regulation.

REGULATIONS

Mines and Mining Plants (Occupational Health and Safety Act): O. Reg. 296/11 amends the
regulation by updating training requirements to reflect changes in the training programs and
clarifying the time limits for completing training; make the occupational noise limits consistent
with those found in other regulations under the Act; updating diesel exhaust exposure limits and
air volume requirements; strengthening hoisting requirements; improving worker safety in shaft
sinking work; strengthening protections related to work on wheel and tire assemblies; and
modernizing provisions to reflect the current administration of the mine rescue program.

Restricted Use of Left Lanes by Commercial Motor Vehicles (Highway Traffic Act): O. Reg.
460/11 replaces paragraphs 1 and 2 of Schedule 11.

Species at Risk in Ontario List (Endangered Species Act, 2007): O. Reg. 4/12 repeals and
replaces schedules 1 - 4.

QUEBEC

ACTS

Building Act: 2011, c. 27 amends section 29 of the Act. 2011, c. 35 makes several amendments
in order to prevent, combat and punish fraudulent practices in the construction industry and
revises the amounts of fines currently imposed under the Act.
Environment Quality Act: 2009, c. 33 adds sections 46.5 - 46.17 establishing a cap-and-trade
system to achieve the previously instituted greenhouse gas reduction targets and makes a minor
amendment to section 96. 2011, c. 20 adds section 96.1, amends section 99 and adds sections
115.13 to 115.28 regarding monetary administrative penalties.

REGULATIONS

Land Protection and Rehabilitation Regulation (Environment Quality Act): O.C. 1294-2011
replaces the second paragraph of section 1.

Regulation respecting threatened or vulnerable plant species and their habitats (Act
Respecting Threatened or Vulnerable Species): O.C. 1299-2011 adds several species to sections
2 and 3 and replaces section 7 regarding plant habitats.

Safety Standards for Road Vehicles (Highway Safety Code): O.C. 1349-2011 amends section
197.1.

Transportation of Dangerous Substances Regulation (Highway Safety Code): O.C. 1349-2011
makes substantial amendments to reflect recent changes made to the Transportation of
Dangerous Goods Regulations (Canada).

EMPLOYMENT LEGISLATION

NEW BRUNSWICK


ACTS

Employment Standards Act: S.N.B. 2011, c. 48 is in force replacing s. 44.031 (Leave for
reservists) and adding reference to this section in ss. 68 and 69.

NEWFOUNDLAND AND LABRADOR

REGULATIONS

Workplace Health, Safety and Compensation Regulations (Workplace Health, Safety and
Compensation Act) N.L.R. 109/11 repeals and replaces Section 28.1 (Deferred payment
arrangement).

NOVA SCOTIA

ACTS

Labour Standards Code: S.N.S. 2011, c. 64 adds section 60J granting employees leave to attend a
citizenship ceremony.

Trade Union Act: S.N.S. 2011, c. 71 adds sections 25A and 40A providing for first contract
arbitration and also amends sections 38 and 93.

QUEBEC

ACTS

Labour Code: S.Q. 2011, c. 30, s. 72 and 2011, c. 31, ss. 15-16 are in force amending the
wording in paragraph 18, replacing paragraph 26 of schedule 1 and amending s. 115.2.1.
