This post contains information about amendments to environmental and occupational health & safety-related acts and regulations in Canada. CANADA

REGULATIONS

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2008-258 has repealed definitions for “accessory mass”, “maximum load”, “maximum loaded vehicle mass”, “normal load”, “normal occupants’ mass”, “occupant distribution”, “optional item”, “production options mass”, “rim base”, “rim size designation”, “rim type designation”, “rim width”, “vehicle capacity mass” and “weather side”. Definition of “cargo-carrying capacity” has been amended. Definitions for “light-truck tire” and “passenger car tire” have been added to the regulation. Subsections 101(2) and 101(9) of Schedule IV to the Regulations are amended. Table II of Section 101 in Schedule IV is amended. Subsections 5.2(c), 6(8) and 6.2(1)(f)(ii) have been amended. Sections 110 (Tire Selection and Rims for Motor Vehicles with a GVWR of 4 536 Kg or less (Standard 110)) and 120 (Tire Selection and Rims for Motor Vehicles with a GVWR of More than 4 536 Kg (Standard 120)) of Schedule IV have been repealed and replaced. Items 110 and 120 of Schedule III have been amended.

ALBERTA

ACTS

Climate Change and Emissions Management Act: 2008, c. 12 (Bill 8) amends the act by repealing and replacing subsections 10(3)(h), (4), 60(1)(d) and 60(1)(z.1). .xml

REGULATIONS

Activities Designation Regulation (Environmental Protection and Enhancement Act): Alta Reg. 158/2008 repeals and replaces subsection 10.1(1)(d) and adds subsection (e) - (f); repeals and replaces subsection 10.1(2)(b) and adds subsection (c) and (d).

Beverage Container Recycling Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 177/2008 amends clause 10(1)(b) (refunds), subsection 18(3) (Board resolution), section 22 (expiry date).

Oil and Gas Conservation Regulation (Oil and Gas Conservation Act): Alta Reg. 159/2008 amends subsections 3.012(e)(ii) and 1.020(2.1). Subsection 1.020(2.2) is repealed. Section 1.030 (Exemption - agents) is added to the regulation. Alta. Reg. 180/2008 adds subsection 12.150(12) (release of information by Board).

Pipeline Regulation (Pipeline Act): Alta Reg. 160/2008 amends subsections 1(6). Subsection 1(7) is repealed. Section 1.1 (Exemption - agents) is added to the regulation.

BRITISH COLUMBIA

ACTS

Protected Areas of British Columbia Act: 2007, c. 27 (as amended by 2008, c. 26) amends the entry for Anhluut'ukwsim Laxmihl Angwinga'asanskwhl Nisga'a [a.k.a. Nisga'a Memorial Lava Bed Park]’

Wildlife Act (R.S.B.C. 1996, c. 488): S.B.C. 2008, c. 33 amends section 84 (fines and penalties).
REGULATIONS

Elevating Devices Safety Regulation (Safety Standards Act): B.C. Reg. 243/2008 amends the Schedule by repealing reference to CAN/CSA Z98-01 with standard, CAN/CSA Z98-07. Column 2 of Item 4 is also amended.

ONTARIO

REGULATIONS

Certification of Drinking-Water System Operators and Water and Quality Analysts (Safe Drinking Water Act, 2002): O. Reg. 323/08 amends definitions “limited groundwater subsystem”, “limited surface water subsystem” and “limited system”. Subsection 8(3) is repealed and replaced. Subsections 10(3)(a) - (b) and 10(5) are repealed and replaced. Subsection 10(3)(b.1) is added to the regulation. In section 13, several references to limited systems and subsystems are replaced with the phrase “drinking water system”.

Compliance and Enforcement (Safe Drinking Water Act, 2002): O. Reg. 328/08 amends the definition of “infraction” in subsection 5(1).
Definitions of "Deficiency" and "Municipal Drinking-water System" (Safe Drinking Water Act, 2002): O. Reg. 329/08 repeals paragraph 1 of section 3.

Definitions of Words and Expressions Used in the Act (Safe Drinking Water Act, 2002): O. Reg. 324/08 amends section subsections 2(1) and (2). Subsection 2(6) is repealed and replaced.

Drinking-Water Systems (Safe Drinking Water Act, 2002): O. Reg. 326/08 adds section 8.0.1 (Systems regulated under the Health Protection and Promotion Act). Section 4.1 is amended to reference the new section.

Drinking-Water Testing Services (Safe Drinking Water Act, 2002): O. Reg. 322/08 repeals and replaces 6(3)(ii)(A) and repeals subsection (D). Subsection 12(3) is amended and (3.1) is added to the regulation. Section 12.1 (Drinking water systems governed under Health Protection and Promotion Act) is added to the regulation. Subsection 13(1)(4) and 15(8.1) are repealed and replaced.

Licensing of Municipal Drinking-Water Systems (Safe Drinking Water Act, 2002): O. Reg. 325/08 Repeals and replaces section 4 (Exemption).

Ontario Drinking-Water Quality Standards (Safe Drinking Water Act, 2002): O. Reg. 327/08 amends subsection 2(2) to remove a reference to a repealed regulation.

QUEBEC

ACTS

Highway Safety Code: More sections of 2007, c. 40 and 2008, c. 14 are now proclaimed in force regarding radar warning devices and photo radar devices. See especially sections 251, 332, 334, 359.3, 592.1-592.4, 597.1, 634.3; and section 440.1 regarding winter tires. Also, more sections of 2004, c. 2 are now proclaimed in force striking out wording in sections 63.1, 81 and 108.

REGULATIONS

Regulation respecting the application of the Environment Quality Act (Environment Quality Act): O.C. 972-2008 amends the regulation by adding subsection 1(6).
