ALBERTA

REGULATIONS

Forest Resources Improvement Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 37/2010 amends clauses 2.1(4)(a) and (b).

Lubricating Oil Material Recycling and Management Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 37/2010 amends clauses 3.1(4)(a) and (b).

Oil and Gas Conservation Regulations (Oil and Gas Conservation Act): Alta. Reg. 39/2010 replaces Schedule 13A and adds Schedule 13B. Clause 4.021(1)(c) and subsection (4.030)(2.2) referencing Schedule 13B are also added.

Specified Gas Reporting Regulation (Climate Change and Emissions Management Act): Alta. Reg. 37/2010 amends s. 2.

BRITISH COLUMBIA

ACTS

Carbon Tax Act: S.B.C. 2010, c. 2 adds subsections 2 and 3 to s. 47 regarding the penalties for failing to remit or pay taxes or security and replaces item 5 (Kerosene) in Schedule 1.

REGULATIONS

British Columbia Building Code Regulation (Local Government Act): B.C. Reg. 45/2010
replaces clause 1.1.1.1.(1)(k) referencing the British Columbia Fire Code Regulation. Please contact the Building and Safety Policy Branch to view the B.C. variations to the National Building Code.

Passenger Transportation Regulation (Passenger Transportation Act): B.C. Reg. 217/2009 repeals Part 8.1 regarding special rules concerning the Olympic and Paralympic Games.
B.C. Reg. 33/2010 repeals paragraphs 9(1)(c)(iii) and (iv) regarding when commercial transport vehicle passengers may stand.

MANITOBA

REGULATIONS

Multi-Material Stewardship (Interim Measures) Regulation (Waste Reduction and Prevention Act): Man. Reg. 40/2010 replaces s. 4 regarding the continuance of the Manitoba Product Stewardship Corporation. S. 6 regarding quorum requirements is repealed. Ss. 18-25 regarding the licensing of stewards of beverage containers, s. 26 regarding a notice of intention to supply container type and s. 27 regarding WRAP levies are also repealed.

Planning Districts Regulation (Planning Act): Man. Reg. 37/2010 renames the Whitemouth River Planning District.

NEW BRUNSWICK

REGULATIONS

General Regulation (Electrical Installation and Inspection Act): N.B. Reg. 2010-44 amends s. 2 in the definition of "Code" to update the reference to CSA Standard C22.1-09.

Provincial Building Regulation, 2002 (Community Planning Act): N.B. Reg. 2010-22 changes a fee amount in subsection 17(1).

Vehicle Dimensions and Mass Regulation (Motor Vehicle Act): N.B. Reg. 2010-36 replaces 8 routes in Schedule B, Part II and Route 108 in Part IV.

Safety Code for Elevating Devices and Amusement Devices (Elevators and Lifts Act): N.B. Reg. 2010-46 replaces paragraph 2(1)(a).

Standards Regulation (Boiler and Pressure Vessel Act): N.B. Reg. 2010-45 amends ss. 3 and 4 of Schedule B.

NEWFOUNDLAND AND LABRADOR

ACTS

Lands Act: S.N.L. 2009, c. 30 replaces subsection 59(1) regarding prohibition against conveying.

REGULATIONS

Protected Road Zoning Regulations (Urban and Rural Planning Act, 2000): N.L.R. 21/10 makes several amendments to Schedule B.

NOVA SCOTIA

ACTS

Motor Vehicle Act: S.N.S. 2009, c. 20 adds sections 106D, 106E and 106F requiring highway motorists to move over one lane and reduce their speed when passing emergency vehicles. Further amendments are made to reflect these changes.

Wilderness Areas Protection Act: S.N.S. 2009, c. 30 amends ss. 23 and 24 regarding certain recreational activities and other permitted activities respectively. S. 5 regarding existing interests is also amended.

REGULATIONS

Mineral Resources Regulations (Mineral Resources Act): N.S. Reg. 35/2010 repeals s. 74
regarding uranium encounters.

Nova Scotia Building Code Regulations (Building Code Act): N.S. Reg. 326/2009 amends clause 10.3.2.7(2)(a).

ONTARIO

ACTS

Occupational Health and Safety Act: S.O. 2009, c. 23 has been applied and is in force June 15, 2010. It makes several amendments that impose an explicit duty on employers to protect workers from violence and harassment in the workplace.

REGULATIONS

Confined Spaces (Occupational Health and Safety Act): O. Reg. 492/09 has been applied and is in force July 1, 2010. It replaces clause (c) of the definition of "acceptable atmospheric levels" and repeals table 1.

Control of Exposure to Biological or Chemical Agents (Occupational Health and Safety Act): O. Reg. 491/09 has been applied and is in force July 1, 2010. It amends the occupational exposure limits for 36 hazardous chemical substances.

Critical Defects of Commercial Motor Vehicles (Highway Traffic Act): O. Reg. 130/10 replaces the title of the regulation and subsection 5(2) as well as making several other minor amendments referencing s. 84 of the Highway Traffic Act.

Designated Substance - Asbestos on Construction Projects and in Buildings and Repair
Operations (Occupational Health and Safety Act): O. Reg. 493/09 has been applied and is in force July 1, 2010. It replaces subsection 2(3) which references the new Ontario Regulation 490/09 (Designated Substances).

General Regulation (Pesticides Act): Ss. 24 and 25, subsections 26(2), (3), (4) and (5) and s. 27 are now in force.

General Regulation (Toxics Reduction Act): O. Reg. 125/10 is a technical amendment allowing for a rolling incorporation to the Federal NPRI Notices.

Healthcare and Residential Facilities (Occupational Health and Safety Act ): O. Reg. 496/09 has been applied and is in force July 1, 2010. It replaces clause (c) of the definition of "acceptable atmospheric levels" in s. 43 and repeals Table 1.

Industrial Establishments (Occupational Health and Safety Act ): O. Reg. 494/09 has been applied and is in force July 1, 2010. It replaces item 8 of the Table to s. 7 referencing the new Ontario Regulation 490/09 (Designated Substances), clause (c) of the definition of "acceptable atmospheric levels" in s. 119.1 and repeals Table 1.

Mines and Mining Plants (Occupational Health and Safety Act ): O. Reg. 496/09 has been
applied and is in force July 1, 2010. It amends the wording in clauses 183.1 (4)(a), 252(1)(b), clause 253(1)(b), replaces clause 254(1)(b), s. 286, clause (c) of the definition of "acceptable atmospheric levels" in s. 294 and repeals table 1.

PRINCE EDWARD ISLAND

ACTS

Pesticides Control Act: S.P.E.I. 2009, c. 13 makes several amendments resulting in a ban on the sale and use of domestic class lawn care pesticides.

REGULATIONS

Pesticides Control Act Regulations (Pesticides Control Act): EC189/2010 makes several
amendments regarding the pesticide licensing process, as well as prohibiting the sale, supply or use of domestic lawn pesticides or pesticides containing 2,4-Dichlorophenoxyacetic Acid.

QUEBEC

ACTS

Act respecting occupational health and safety: S.Q. 2009, c. 19, s. 21 has been applied and is in force July 1, 2010 (except enacting s. 237.1). It replaces ss. 236 and 237 introducing progressive increases in fines to which an employers may be liable if they fail to meet their obligations under the Act or if they compromise the health, safety or well-being of an employee.

Highway Safety Code: S.Q. 2007, c. 40, s. 11, the wording ", a moped" is now in force and added to s. 66.1. S.Q. 2009, c. 48 makes several amendments regulating the use of cameras for the purpose of photographing vehicle registration plates on public roads. S.Q. 2009, c. 55 makes several amendments regarding regulatory power over driving schools and courses. Sections 62, 66.1, and 660 are amended.

Public Health Act: S.Q. 2009, c. 45 sections are now in force repealing Chapter III, adding ss. 51.1, 130.1 - 130.6 and amending ss. 36, 42, 52, 95, and 137. The amendments provide for the establishment of a public health ethics committee by the Institut national de sante publique du Quebec and broaden the government plan to protect the public against vector-borne diseases, including West Nile Virus.

REGULATIONS

Forest Protection Regulation (Forest Act): O.C. 180-2010 amends the dates in ss. 1 and 2 to extend by one year government assistance in order that the forest industry will not have to pay part of the costs for the extinction of forest fires and the suppression of insect infestations during that period.

Rate Structure Relating to the Treatment of Industrial Wastewater By-law (129): By-law 05-072 replaces the definitions of "director" and "Direction" and adds a definition for "alum dose". Further amendments are made to reflect these amendments. Section 7 is repealed.

Regulation respecting wood-burning appliances (Environment Quality Act): O.C. 245-2010 postpones the provisions concerning furnaces and boilers to April 1, 2011.

YUKON

REGULATIONS

Interim Whitehorse Periphery Development Area Regulations (Area Development Act): O.I.C. 2010/37 amends the definition of "guest cabin accommodation units" in s. 27 and adds s. 37 regarding uses of Lot 1028, Quad 105D/14. O.I.C. 2010/44 adds s. 35 with respect to accessory uses of Residential lot 1015-2, Quad 105D/14 and s. 36 regarding the definition of "home based business".

Thanks for posting this list of amendments. I'm sure this will be useful to a lot of people. I wonder with the act respecting occupational health and safety: S.Q. 2009, c. 19, s. 21 has been applied and is in force July 1, 2010 (except enacting s. 237.1). It replaces ss. 236 and 237 introducing progressive increases in fines to which an employers may be liable if they fail to meet their obligations under the Act or if they compromise the health, safety or well-being of an employee. - how many employers will install office/home security systems (https://www.alarm.com/) to make sure that their employees are complying with amendments to the act.
