Sylvain -
Go to the WSIB - don't "send" them your stuff - Talk to them first. They will offer advice and may ask for your materials (but I doubt that). They will not take sides in what appears to be rapidly becoming an employment legal issue.
Removing your toolbox could set yourself up for being classified as "quitting" your job (which is likely what the management hopes you will do). I can offer you no advice on this. You are in Ontario - there are many "OHS" legal firms who take on cases on a "contingency" basis, or who do legal services outreach. There are also community law offices for those unable to afford legal advice .... they operate either free or for a nominal cost.
Look up the availability of provincial government employment counselling services. They might be called "labour standards", employent commission", "employment tribunal", etc. There is the Employment Standards Act in Ontario - look it up.
Where you feel strongly about this - stop wasting time in here and do something "practical" about it. Talk to the Labour Relations people. Here is the site: http://www.labour.gov.on.ca/english/feedback/feedform.php?source=lr
Get professional advice.

I already asked if I can meet with WSIB. I was told that there is no need since the decision is already made.
When I spoke to WSIB for the first time, the lady called the employer and then called me back stating that I refused the light duties offered to me (which is a lie) and then without even listen to my side of the story, she told me that there is nothing she can do.
The good part is, I have proof of all those lies including the one from yesturday.
I do believe that the WSIB is taking sides.
I would like to thank you for all the answers.
I really appreciate .
Regards,
Sylvain

Hi Sylvain,
I'm glad that you feel comfortable in posting to Workscape, and that you are seeking advice about your situation. Keep in mind, however, that it may be necessary for you to get professional OHS assistance beyond the words and posts of other Workscape members, as Sailor above has mentioned. If you would like to contact me via private message (click on my name "admin" above) I'd be happy to provide you with some options.

If the WSIB has made a decision ask for the letter that has stated just that. Once you get that letter from the WSIB draft a leeter stating that you disagree with the decision letter and notify that you would like to appeal.

Furthermore forward all your documentation to the WSIB that supports your case. It goes into their files so that if you do go before an appeal it will all be there ready to go

Sorry having a coffee and thinking random thoughts..It may be in your benifit to draft a letter stating you are willing to accept modified duties based on your functional abilities and cc the WSIB.

According to WSIB a decision letter has been sent at the beginning of my claim.(Tuesday February 2, 2010 )
When I called WSIB on February 23, 2010 to see if they sent the letter.
My adjudicator said that she will verify my mailing address. I’ve explain that I received documents in regards to medication and health care benefits from them on January 28, 2010. Obviously they had the correct mailing address.
I also send them (February 17, 2010) the whole description of the accident (details, e-mails, pictures, transcription of recordings, recordings). When I spoke to my adjudicator and asked her if she received the documents and read it she replied “yes I did”.
I explained to her that I have to mail my new FAF to the company.
She then asked me why I don’t just bring it when I go to work.
It’s obvious that she didn’t read anything for the fact that it’s written that the company never replied to my e-mails in regards to when I should start light duty work.

Good afternoon,
I just got back from my specialist appointment I am in luck I do not need to have an operation on my finger to get the foreign body out of it.
I have an appointment on Tuesday in the afternoon, so I am unable to meet with you then. However I am able to come in on Wednesday to go over things with you and to start work flipping donuts on this day. I will also bring you the FAF form on this day.
If you would please confirm a time for the meeting and, and a time to when I should be at the other plant to start flipping donuts it would be very appreciated.

If it's possible for you to let me know who is supposed to contact me because after our conversation on On Monday January 25, 2010 you told me that Zoran or Joy would be contacting me and when I spoke with him yesturday he told me that there is nothing in regards to that on the e-mail you've sent him and that he has nothing to do with it.
I’ve been told that I refused to do the light duties (flipping donuts) by the lady at WSIB.
On Friday, January 29, 2010 I called Zoran to let you know about the restrictions written on the 2nd FAF form. Then he asked me “Does that mean that you are not going to finish with the racking?” I answered “No, I can’t use my left hand” his response was “we had a case like this before and on Monday you will be flipping donuts” I answered “ok”. Then he told me that he will call me back.
About 30 minutes later he called me and informed me that on Monday I have to go to the head office with the FAF form, not a doctors note and that I will have to talk to you. Which I did.
I do believe that when I mentioned to you that I can use my skills for a better purpose than flipping donuts.
From my understanding. You thought that I was refusing to flip donuts when all that I was suggesting was that I can use my skills to help in the maintenance department by reorganizing it.
I am sorry for the misunderstanding but according to my conversation with Zoran Friday, January 29, 2010. I was supposed to start Monday flipping donuts at one plant and half an hour later I am not. Instead I have to go to the head office to bring you the 2nd FAF form and talk with you.
I know that I am supposed to keep somebody updated but at this point I don't know who anymore.
Best regards,
Sylvain Grenier
I still didn’t received a copy of form 7 even after 1 verbal request and 1 written (E-mail 9)
The story get so twisted as it goes along.
If you would like to read and listen to the whole situation, just let me know.
