This message contains information about amendments to environmental and occupational health & safety-related acts and regulations in Canada. CANADA

ACTS

Marine Liability Act: 2009, c. 21, ss. 1_10, 12, and 14_16 are now in force making amendments to Parts 3 and 4 as well as the new maritime lien for ship suppliers.

ALBERTA

REGULATIONS

Energy Resources Conservation Board Administration Fees Regulation (Energy Resources Conservation Act): Alta. Reg. 225/2009 has been amended to repeal and replace subsection 4(1) dealing with coal mines.

Forest Resources Improvement Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 206/2009 amends the regulation so its expiration date is now February 28, 2011.

BRITISH COLUMBIA

ACTS

Motor Vehicle Act: Sections of B.C. 2008, c. 42 have come into force. Section 25 is amended to require applicants to provide proof of Canadian citizenship in addition to other requirements
where applicants request the licence indicates Canadian citizenship. Section 31 is amended in consequence of changes to section 25. Amendments to section 26.1 empowers the Insurance Corporation of British Columbia to cancel a licence that indicates Canadian citizenship.

REGULATIONS

Gas Safety Regulation (Safety Standards Act): B.C. Reg 134/2009 amends the regulation to add section 3.1 (Relation to the Safety Standards General Regulation). Section 20 and paragraph 8(1)(d) have been repealed. Sections 6, 7 and 8 dealing with gas fitter certificates have been amended.

Power Engineers, Boiler, Pressure, Vessel, and Refrigeration Safety Regulation (Safety Standards Act): B.C. Reg. 133/2009 has amended the regulation to update references to various standards. B.C. Reg. 134/2009 has added definitions for "fifth class plant", "first class plant", "fluid heating plant", "fourth class plant", "heating plant", "second class plant", " standardized certificate of competency", "steam heating plant", "steam heating plant" and "third class plant". Various sections throughout have been amended to reflect changes in terminology. Sections 10, 12, 14, 16, 18, 30 and 47 _ 53 have been repealed. Sections 9 (Marine (steam) certificate competency) , 20 (What a first, second, third or fourth class power engineer may do), 23 (Fifth class power engineer's certificate of qualification), 24 (What a fifth class power engineer may do), 26 (What a refrigeration operator may do), 31 (Application procedure for an oil well boiler operator's certificate of qualification) and 32 (What an oil well boiler operator may do) have been repealed and replaced.

MANITOBA

REGULATIONS

Electricians Licensing Regulation (Electricians' Licence Act): Man. Reg. 146/2009 amends the regulation to update sections 15 and 18. Reference to "non_energized trench cables" has been added to the schedule.

NEW BRUNSWICK

REGULATIONS

Watershed Protected Area Designation Order (Clean Water Act): N.B. Reg. 2009_115 amends A.14 in the Index of Plans of Protected Areas.

Wellfield Protected Area Designation Order (Clean Water Act): N.B. Reg. 2009_114 amends A.2, A.9 and A.10 in the Index of Plans of Protected Areas.

NOVA SCOTIA

Air Quality Regulations (Environment Act): N.S. Reg. 261/2009 amends the regulation to lower caps for sulphur dioxide and nitrogen oxide emissions in section 6 and Schedule C.

Environmental Assessment Regulations (Environment Act): N.S. Reg. 277/2009 amends the regulation to establish small scale refinery projects as Class 1 undertakings in Schedule A.

Renewable Energy Standard Regulations (Electricity Act): N.S. Reg. 303/2009 amends the regulation to change the year of commencement of renewable low impact electricity standards to 2011.

ONTARIO

REGULATIONS

Waste Electrical and Electronic Equipment (Waste Diversion Act, 2002): O. Reg. 320/09 amends the regulation to add paragraph 4 to subsection 5(1). Section 6 has been repealed. Subsections 7(1) and (2) have been amended.

SASKATCHEWAN

REGULATIONS

Saskatchewan Fire Code Regulations (Fire Prevention Act, 1992): Sask. Reg. 86/2009 amends subsections 2(1)(e) and 3(1) to make reference to the National Fire Code of Canada 2005.
