This message contains information about amendments to environmental and occupational health & safety-related acts and regulations in Canada. CANADA

ACTS

Hazardous Products Act: SOR/2009-109 repeals item 17 from Part I of Schedule I and adds item 3 under Part II of Schedule I regarding glass doors and enclosures. SOR/2009-111 adds item 4 to Part II of Schedule I regarding corded window covering products.

REGULATIONS

Domestic Substances List (Canadian Environmental Protection Act, 1999): SOR/2009-1 amends Part 1 of the DSL by deleting 2 substances and adding 5. SOR/2009-2 adds 13 substances to Part 1, 1 substance to Part 2, 12 substances to Part 3, and 1 substance to Part 4. SOR/2009-39 adds 9 substances to Part 1, 2 substances to Part 2, 14 substances to Part 3, 2 substances to Part 4, and 1 substance to Part 5. SOR/2009-82 deletes 3 substances from Part 1 and adds 3 substances to Part 2. SOR/2009-106 adds 3 substances to Part 1 and 13 substances to Part 3 of the DSL.

Exclusion List Regulations, 2007 (Canadian Environmental Asessment Act): SOR/2009-88 amends the regulation to reduce the duplication in the provincial and federal assessment processes. Projects under the Building Canada plan have been excluded by adding them to this regulation. Where the provincial process meets prescribed requirements related to the content of the environmental assessment and public participation, the Minister may wave the requirement of a federal environmental assessment.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2009-79 is reenacting sections 105, 121, 131, 135 and 301 of Schedule IV to extend their expiration dates. The safety requirements referenced through the Technical Standard Documents remain in force.

Pest Control Products Incident Reporting Regulations (Pest Control Products Act): SOR/2009-94 amends several sections regarding translation delays, scientific studies, incidents in the United States, and cases where registrants cease to be registrants of a product.

Pest Control Products Sales Information Reporting Regulations (Pest Control Products Act): SOR/2009-101 amends section 8 of the French version regarding reporting of sales information to the Minister upon request.

Sulphur in Gasoline Regulation (Canadian Environmental Protection Act, 1999): SOR 2009-93 amends the English version by replacing paragraph 1.1(c) which aligns the English and French versions.


BRITISH COLUMBIA

ACTS

Motor Vehicle Act: The section of 2007, c. 14 (as amended by 2008, c. 42) which adds clause 26(1)(g) is now proclaimed in force regarding the refusal of a driver's licence for refusal of payment of alimony or support.

Wildlife Act: The sections of 2008, c. 33, which replace the definition of officer in section 1(1) and replace section 51(1) (a) and (b) describing who may be issued guide outfitter licences, are now proclaimed in force.

REGULATIONS

Contaminated Sites Regulation (Environmental Management Act): Environmental media to which the Regulation applies has been be expanded to include vapours, in addition to soil, water and sediment. B.C. Reg. 341/2008 amends the regulation by implementing part of a series of changes to include new standards in what constitutes a contaminated site and remediation. B.C. Reg. 343/2008 amends the regulation by implementing part of a series of amendments to environmental legislation. Schedule 10 (Generic Numerical Soil and Water Standards) is simplified by eliminating the Practical Quantification Limits (PQLs). Requirements for an assertion by a responsible person that ecological receptors will not be significantly impacted have been removed. Schedule 11 (Generic Numerical Vapour Standards) has been added to the regulation.

Hazardous Waste Regulation (Environmental Management Act): B.C. Reg. 63/2009 replaces section 43(1) which requires registering hazardous waste if the quantity is greater than the amount set out in Column II of Schedule 6.

Integrated Pest Management Regulation (Integrated Pest Management Act): B.C. Reg. 426/2008 and 427/2008 amends sections 5, 21, 64, 71 and 78, to regulate the application of pesticides to control mosquitoes and the spread of the West NileVirus. Subsection 64(3) has been replaced and outlines the public notice required when applying pesticides to control mosquitoes, including written notice to apiaries registered under the Bees Act. Section 78 is amended to control the conditions under which methoprene may be used.

Motor Vehicle Act Regulations (Motor Vehicle Act): B.C. Reg. 351/2008 amends the regulation to repeal and replace definitions for golf cart and utility vehicle. Division 24 (Vehicles of Unusual Size, Weight or Operating Characteristics) has been repealed and replaced. Several other amendments have been also amended to reflect the new Division 24. This division deals with vehicles such as golf cars and low and zero emission vehicles.

Reviewable Projects Regulation (Environmental Assessment Act): B.C. Reg. 40/2009 adds the definition of a proposed facility to section 7 and adds proposed facility to section 8(1) and (2).


MANITOBA

REGULATIONS

Employment Standards Regulation (Employment Standards Code): 5/2009 amends the act to update section 11 (Minimum wage).

Pesticides and Fertilizers Licence Regulation (Pesticides and Fertilizers Control Act): Man Reg. 185/2008 amends the regulation to add several definitions and references to the Pest Control Products Act (Canada) and its regulations. The amendments and additions deal with restrictions and licencing of pesticide dealers., including displaying products containing capsaicin. As well, section 7 (Disposal of pesticides and containers) has been repealed and replaced.

Workers Compensation Act: Man. Reg. 188/2008 amends the Act to update the compensation amounts for 2009.

NOVA SCOTIA

REGULATIONS

Weights and Dimensions of Vehicles Regulations (Motor Vehicle Act): N.S. Reg. 32/2009 amends the regulation to add Schedule D (Intermediate Weight Roads). References to Maximum Axle Weights for B-train Routes have been replaced with the term 'Intermediate Weight Roads'.

ONTARIO

REGULATIONS

Electrical Safety Code (Electricity Act, 1998): O. Reg. 453/08 updates the reference to the Canadian Electrical Code in section 1, effective May 1, 2009.

Safety Inspections (Highway Traffic Act): O. Reg. 42/09 repeals section 11.1 (inspection stickers - City of Ottawa) effective may 1, 2009.

QUEBEC

REGULATIONS

Forest Protection Regulation (Forest Act): O.C. 442-2009 amends sections 1 and 2 by replacing the year 2009 with 2010.

SASKATCHEWAN

REGULATIONS

Reservoir Development Area Regulations (E-10.2, Reg. 1) (Saskatchewan Watershed Authority Act, 2005): Sask. Reg. 24/2009 amends the appendix with respect to the maps for the Blackstrap and Lake Diefenbaker Reservoir Development Areas.
